FHA Guidance on Short Sales


FHA has provided guidance on borrowers that have had previous short sales:

Borrowers are considered eligible for a new FHA mortgage if:

1. They were current on their mortgage and other installment debts at the time of the short sale of their previously owned property, and

2. The proceeds for the short sale serve as payment in full**

**Example: Most Lender approval letters for short sales we receive have a repayment plan/promissory note in place for the remaining balance due.

This is not considered payment in full.

3. All mortgage payments due on the prior mortgage were made within the month due for the 12 month period preceding the short sale and

4. All installment and revolving debt payment for the same time period were also made within the month due

Borrowers in default on their mortgage at the time of the short sale/pre-foreclosure sale are NOT eligible for a new FHA mortgage for three (3) years from the date of the sale.

Under certain circumstances exceptions can be made for borrowers in default at the time of the short sale if:

1. The default was due to circumstances beyond the borrower’s control (such as death of primary wage earner, documented long term un-insured illness) AND NOTE: FHA does not recognize 6 months as a long term illness

2. The review of the credit report indicates satisfactory credit prior to the circumstances beyond the borrower’s control that caused the default

These are the only exceptions. Loss of employment is NOT an exception

Borrowers are not eligible for a new FHA insured mortgage if they pursued a short sale agreement on his or her principal resident simply to:

1. Take advantage of declining market conditions, and

2. Purchase at a reduced price a similar or superior property within a reasonable commuting distance

Borrowers with short pay offs should contact the original lender to inquire about possible refinancing the outstanding indebtedness.
